Our role
Rackyard rents out servers. Our customers decide what runs on them, and we do not review that content in advance. When someone tells us that content on our network infringes their copyright, we act on the notice as described here. This policy applies to notices under the Copyright Act, 1957 and the Information Technology Act, 2000, and we also accept notices written for the US Digital Millennium Copyright Act (DMCA).
Sending a notice
Email support@rackyard.cloud with the subject “Copyright notice”, and include:
- your name, postal address, phone number and email address;
- the work you say is infringed, and evidence that you own it or act for the owner;
- exactly where the infringing content is: full URLs, or the IP address, port and path, so that it can be found without guesswork;
- a statement that you believe in good faith that the use is not authorised by the owner or the law;
- a statement that the information in the notice is accurate; and
- your physical or electronic signature.
Incomplete notices slow everything down; we will ask for what is missing. Sending a notice you know to be false can make you liable for the harm it causes.
What happens next
- We acknowledge a complete notice within 24 hours and forward it to our customer.
- The customer has 48 hours to remove the content or send us a counter-notice. If they do neither, we disable access to it ourselves, which may mean suspending the service.
- If a court order is needed under Indian law to keep the content down, we tell the complainant, and we may restore access if no order is produced within the time the law allows.
If you are the customer
If you believe content was taken down by mistake, or you have the right to use it, reply to our email with a counter-notice: your name and contact details, the content and where it was, why you believe the notice is wrong, a statement that the information is accurate, and your signature. We pass the counter-notice to the complainant, and may restore the content unless they tell us they are taking legal action.
Repeat infringers
We terminate the services of customers who repeatedly host infringing content, as set out in our Acceptable Use Policy. As a guide, three valid notices about a customer in twelve months that were not answered with a counter-notice will lead to termination. Services terminated for this reason are not refunded.
Other complaints about content
For other unlawful content, such as phishing, malware or harassment, use the reporting route in our Acceptable Use Policy. For a complaint about how we handled a notice, email support@rackyard.cloud.
